Introduction
For the purposes of these Terms and Conditions, “The
Promoter” refers to Playmania LTD. By entering the
competition, you agree to be bound by these terms and
conditions. The giveaway competition will be held on a
weekly basis. Each week a new giveaway competition will be
held.
Eligibility and Entry Restrictions
Entrants must be over 18 years old on the date of their
entry. Only one (01) entry per person per competition will
be accepted. The Promotors competitions with entry are
open only to residents of [*]. To enter into the
competition, ALL social platforms of the Promoter will
have to be followed. One (1) winner will be chosen at
random from all entrants and across all platforms. No
purchase is required to enter into the competition, unless
otherwise stated. Purchase does not enhance chance of
winning. The maximum number of entries for a competition
shall be at the Promotor’s sole discretion. Once
this number of entries have been received, the competition
will be closed to new entries, notwithstanding the
published closing date.
Winners and Prizes
The winner will be chosen by drawing a random number using
https://www.random.org/. The winner’s name and social media username may
be posted on the social media profiles of the Promotor
after the winner has been selected. The Prize will be
awarded to a randomly selected winner who has entered in
this competition. The Promoter will not be held liable if
the named prize becomes unavailable or cannot be
fulfilled. Prizes are drawn in Tel-Aviv, Israel timezone.
Promotor will allow shipping to all countries subject to a
limit to this shipping cost. Promotor shall not strictly
be responsible to any other costs except shipping costs.
Prize winners will be notified via email sent to the
Promotor’s full subscriber list as well as a direct
email to the winner will be sent. Promotor shall make all
reasonable efforts to notify the winner, via email. If the
winner does not respond to this email notification, they
will forfeit the prize. If a prize is not claimed within
21 days, Promotor reserves the right to do a redraw. If a
redraw is done, a new winner will be announced. No future
claims on the prize will be available to the subscriber
who failed to respond to the winning notification. If a
user does not claim the prize, respond to the email at a
certain predetermined time as mentioned by the Promotor,
the Promotor will have the right to transfer the prize to
another user, or conduct a new lottery at its sole
discretion. Prizes are non-negotiable, non-transferable
and non-refundable. No cash alternative is available.
Where a Prize becomes unavailable for any reason, the
Promoter reserves the right at its sole discretion to
substitute that prize.
Limitation of Liability
The Promoter’s decision in respect of all matters to
do with the competition will be final and no
correspondence will be entered into. The Promoter will not
be held liable for any failure of receipt of entries. The
Promoter takes no responsibility for any entries which are
lost, delayed, illegible, corrupted, damaged, incomplete
or otherwise invalid. The Promoter reserves the right to
not release the prize at the end of the competition
without prior notification, in case if reasonable number
of users fail to participate in the giveaway contest. The
Promoter shall have no liability whatsoever, under or in
connection with the competition or these terms and
condition. To the extent permitted by applicable law, the
Promoter’s liability under or in connection with the
competition or these terms and conditions shall be limited
to the cost price of the Prize in question. To the extent
permitted by applicable law, The Promoter shall not be
liable under or in connection with these terms and
conditions, the competition or any Prize for any indirect,
special or consequential cost, expense, loss or damage
suffered by a participant even if such cost, expense, loss
or damage was reasonably foreseeable or might reasonably
have been contemplated by the participant and the promoter
and whether arising from breach of contract, tort,
negligence, breach of statutory duty or otherwise. In the
event of unforeseen circumstances beyond The
Promoter’s reasonable control, the promoter reserves
the right to cancel, terminate, modify or suspend the
competition or these terms and conditions, either in whole
or in part, with or without notice.
Governing Law
The competition and these terms and conditions will be
governed by the Basic Laws of the State of Israel and any
disputes will be subject to the exclusive jurisdiction of
the Courts of Israel.
Release
By receipt of any Prize, the winners agree to release and
hold harmless the Promoter, and their respective parent
companies, subsidiaries, affiliates, suppliers,
distributors, advertising/promotion agencies, and prize
suppliers, and each of their respective parent companies
and each such company’s officers, directors,
employees and agents (collectively, the “Released
Parties”) from and against any claim or cause of
action, including, but not limited to, personal injury,
death, or damage to or loss of property, arising out of
participation in the competition/contest or receipt or use
or misuse of any Prize. The winner agrees to take part in
reasonable publicity in connection with this contest and
Prize (if requested) as reasonably requested by the
Promoter.
Confidentiality
By entering, the information you provide may be shared by
the Promoter with and/or its subsidiaries. You may be
contacted by the Promoter, and/or any promotional partner
with future promotional offers. Information provided by
you to participate in this contest/competition is subject
to the opt-out and privacy policies for the Promoter and
any promotional partner(s).
LEGAL WARNING: ANY ATTEMPT BY AN
INDIVIDUAL, WHETHER OR NOT AN ENTRANT, TO DELIBERATELY
DAMAGE, DESTROY, TAMPER OR VANDALIZE THIS WEB SITE OR
INTERFERE WITH THE OPERATION OF THE CONTEST, IS A
VIOLATION OF CRIMINAL AND CIVIL LAWS AND PROMOTER RESERVES
THE RIGHT TO SEEK DAMAGES AND DILIGENTLY PURSUE ALL
REMEDIES AGAINST ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT
PERMITTED BY LAW.
